Law360: Privacy & Cybersecurity Litigation to Watch in 2026

Michael Gold, partner and Chair of the firm’s Cybersecurity and Privacy Group, was recently quoted in the Law360 article, “Privacy & Cybersecurity Litigation to Watch in 2026.” The article examines the litigation and trends attorneys feel will shape the privacy and cybersecurity landscape in 2026, including the search for clarity on website tracking and the California Invasion of Privacy Act (CIPA)

Gold commented to Law360, “Overall, there’s been an absence of clarity on these issues,” noting that CIPA claims are expected to keep being “a fruitful area for claimants” until the state legislature “can do something to clarify the law.”

Gold also pointed to an October decision by U.S. District Judge Vince Chhabria that slammed CIPA as being “a total mess” that routinely requires courts to make “borderline impossible” decisions about how to apply the law’s language to new technologies. Pointing to the growing body of conflicting decisions on key statutory interpretation issues, the judge urged state lawmakers to bring the law into the 21st century.
