The Signal: Opinion on Cemex fight due in February

The Signal highlighted JMBM’s representation of Cemex in its ongoing litigation with the State Water Resources Control Board in the article, “Opinion on Cemex fight due in February.” Both sides recently argued before the Second District Appellate Court of California over whether Cemex should be able to challenge a state water board decision before the expected final ruling in February

Representing Cemex in the matter, JMBM partner Matthew D. Hinks argued that the blame for the delay in the company’s plans to mine 56 million tons of Soledad Canyon’s sand and gravel lies with the State Water Resources Control Board, with the board arguing it is not to blame for inactivity.

“I would allege that,” said Hinks during his rebuttal. “Because it is true.”

Hinks said the current appeal is really about an opportunity for Cemex to be able to litigate its claim in front of the State Water Resources Control Board after the international mining giant was told that the water agency’s decision to renotice the application was not subject to appeal.
