Law360: Meta Privacy Verdict Raises Stakes For Website Data Tracking

Bob Braun, co-chair of the Cybersecurity and Privacy Group with JMBM, was recently quoted in the Law360 article, “Meta Privacy Verdict Raises Stakes for Website Data Tracking.” The article looks at the California federal jury verdict finding that Meta had intentionally recorded sensitive health data users entered into a popular online tracking tool, Flo, violating the California Invasion of Privacy Act.

Braun told Law360, “What is obvious following this verdict is that plaintiffs are going to be emboldened, and anyone who uses these tracking tools is going to have to rethink their practices to make sure they’re making adequate disclosures.” He added that companies that deal in highly sensitive data will need to “redouble these efforts” given the heightened scrutiny surrounding such information.

He also noted, “Businesses need to be more self-aware and focus on assessing what data practices really bring value and whether they’re consistent with their stated goals and purposes. The days of coming in and just collecting and selling everything are over.”
