JMBM partner Jon Weininger represented All Net Land Development LLC and David Lowden (the land development defendants) in a RICO lawsuit involving accusations of faulty loans surrounding a failed Las Vegas strip basketball arena and resort. A federal judge has now rejected the RICO suit, finding that a Superior Court suit filed over four years prior set the clock for a legal deadline the plaintiffs missed.
Weininger praised the ruling, telling Courthouse News Service, “On behalf of the property owners, we are pleased that the court correctly decided that plaintiffs’ RICO claim is time barred and must be dismissed. For far too long, the plaintiffs have pursued spurious claims against the property owners only to have their claims soundly rejected by the courts. We hope that with today’s ruling, plaintiffs’ meritless legal campaign against the property owners will finally come to an end.”
