4 Cases Discrimination Attys Should Watch as 2025 Rolls On

JMBM partner Travis Gemoets was recently quoted in the Law360 article, “4 Cases Discrimination Attys Should Watch as 2025 Rolls On.” The article looks at the four cases discrimination attorneys will be tracking in the second half of the year. Gemoets discussed the Workday AI bias suit, a California case that is being closely monitored by employment lawyers for its “potential precedent-setting implications on artificial intelligence-powered tools.”

Gemoets told Law360 the procedural nuances of the case bear watching even before any final decision is rendered, such as whether the matter settles or if it makes it to trial. He said the key takeaway is that the case and the judge’s certification order demonstrate that screening tools or tools that compare people’s resumes or backgrounds could violate the ADEA and potentially other federal and state laws.

“This case says we’ll let the plaintiffs prove their case that it’s the algorithm that is preventing the older workers from having their applications … highlighted or forwarded to the employer,” Gemoets said. “It absolutely will have a chilling effect on any company that’s using algorithms or metrics or tools like this to ensure that they are not discriminating, even if it might be unintentionally against one group or another.”
